New Delhi: Chief Justice of India Justice Surya Kant has decided not to hear a case about the rule for choosing Election Commissioners. He said this is to avoid any chance of unfairness or conflict of interest.
The case is about a 2023 law that changed how the Chief Election Commissioner (CEC) and other Election Commissioners are selected. Earlier, the Chief Justice was part of the selection panel, but the new law removed this role.
The CJI said it would be better if this case is heard by judges who are not likely to become the Chief Justice in the future. Senior lawyer Prashant Bhushan also supported this idea, saying it will help keep the process fair and free from doubt.
After this, the CJI ordered that the case be heard by a new bench on April 7.
The law has been challenged by people including Congress leader Jaya Thakur and the Association for Democratic Reforms.
Now, the Supreme Court will decide if this law follows the Constitution or not.
